In order to file for Chapter 13 bankruptcy (also called the wager earner's plan), you must have an income from which you can make partial repayment of your debts. In Chapter 13, you might be able to keep your assets including your home and car, and there is generally more room to negotiate your debts.

In Chapter 13 bankruptcy, the debtor shows that his or her current debt payments are unmanageable and proposes a repayment schedule (usually over a three to five-year period). Payments are made using disposable income, which is the money you have remaining in your bank account after all necessary living expenses have been paid each month. The Bankruptcy Court will then accept or alter the proposed repayment plan and oversee the debt repayments. One major advantage of Chapter 13 bankruptcy is asset protection. It offers many homeowners a way to avoid home foreclosure or repossession of a vehicle.
